Nevada Shocks Nation with Bold New Weed Law

Reading Time: 2 minutes

Nevada lawmakers have forwarded a comprehensive marijuana reform bill to the governor.
This bill, brought forth by Senator Dallas Harris, would effectively double the personal possession limit for cannabis from one ounce to 2.5 ounces, as well as the amount of cannabis concentrated from one-eighth of an ounce to one-quarter of an ounce.
About The Bill
The bill also aims to simplify licensing rules. For instance, adult-use marijuana retailers would no longer require a separate medical cannabis license to serve patients, thus automatically acting as dual licensees. Further, regulators would not issue or renew medical marijuana licenses after January 1, 2024, unless the applicant is in a jurisdiction that has chosen not to permit adult-use facilities. Fees for licensing applications and renewals would also be reduced, and medical cannabis patients would be exempt from the state excise tax at recreational retailers.

Notably, the bill would allow people with prior felony convictions to potentially receive marijuana business licenses. The Nevada Cannabis Compliance Board would have the discretion to approve these licenses if it determines that doing so would not adversely affect public health or the cannabis industry in the state.
Legislation
The legislation also proposes that the state Cannabis Advisory Commission conduct a study on the implications of removing marijuana from the federal Controlled Substances Act and the state’s Uniform Controlled Substances Act1. Additionally, it would require regulators to consider the environmental impact of any proposed rule changes for the industry.
In related news, the Nevada legislature recently approved a resolution urging Congress to federally legalize marijuana. Lawmakers also approved a bill to form a new working group to study psychedelics and develop a plan for regulated therapeutic access. Additionally, Nevada law enforcement regulators have proposed a revision to the state’s employment policy, which would prevent prior marijuana possession convictions for amounts now legal from disqualifying police recruits.
